Captive registration
Section 13 of the Act requires a captive generation company to register. It does not require a licence.
Registration by itself authorises you to generate and consume the electricity at your own premises. That is the whole of what a certificate of registration permits.
To supply anyone else, even a company in your own group, you must first obtain the concurrence of the Authority.
What you file
- Form A-1 with the particulars in Schedule II
- Form U-1 verification on oath
- Form U-4 undertaking as to captive use, sworn
- Form U-6 declaration of solvency
- Single line diagram, site plan and metering schedule
Sunlight in, metered, consumed on site
The commonest captive arrangement in Sindh: an array on the roof or in the yard, the generation and the consumption metered separately as regulation 37 requires, and nothing leaving the premises. That is registration under section 13, and no licence at all.
Draft fee schedule: not yet notified
The figures below are from the draft Fees and Charges Regulations, 2026. They are indicative and subject to change. No fee or period in that draft is enforceable until the instrument is notified in the official Gazette.
Registration fee Draft
| Installed capacity | Registration | Annual |
|---|---|---|
| Up to 500 kW | 10,000 | 5,000 |
| 500 kW – 2 MW | 25,000 | 12,500 |
| 2 – 5 MW | 50,000 | 25,000 |
| 5 – 10 MW | 100,000 | 50,000 |
| Above 10 MW | 250,000 | 125,000 |
Draft figures in rupees. The draft provides for an annual fee at half the registration fee, due 31 July. These provisions are not yet notified.
Annual return
A registrant files Form R-1 each 31 July: net generation, self-consumption, and the quantum supplied under each concurrence. Quantities only, no commercial terms. No fee.
Bagasse and biogas count too
A sugar mill burning its own bagasse, or a digester on farm waste, is captive generation in exactly the same way as a solar array. The fuel makes no difference to the instrument you need. What matters is who consumes the electricity.
Concurrence
Concurrence is a written confirmation by the Authority, given before supply begins, that a proposed supply within your corporate group falls within captive use. It is not a licence.
Who may be supplied
A company which controls you, which you control, or which is under common control with you. More than fifty per cent of the voting rights, or the power to appoint a majority of directors.
The five grounds of refusal
Not an affiliate; not within regulation 5(2); the affiliation is one created to bring the supply within captive use; metering inadequate; or you are in breach of an existing condition. No other ground.
What the Authority may not do
It may not examine, approve or refuse the price or any commercial term of the supply. Concurrence verifies who and how much, never for how much.
Supplying occupiers at a group company’s premises
Concurrence is granted on two further conditions. Each occupier must be metered individually, and the group company may not recover from an occupier more than it pays you for that occupier’s electricity. Without the second condition the group company would be an unlicensed reseller taking a margin.
Concurrence is decided within 30 working days of a complete application. It is renewable, and where you apply before expiry it continues in force until the application is decided.
The five licences
Generation licence
Construct, own and operate a generation facility and sell the output to a person authorised to buy it. A generation licence does not by itself authorise supply to a consumer.
Form A-2 · indicative term up to 30 years
Electric power supply licence
Supply consumers within a service territory, which may be geographic, spatial or virtual. A virtual territory is defined by the consumers you have contracted with rather than by area.
Form A-3 · indicative term up to 20 years
Distribution licence
Build and operate a distribution system. You must provide access to others on terms no less favourable than you give your own supply business, and ring-fencing conditions apply.
Form A-4 · indicative term up to 25 years
Microgrid licence
A single unified instrument for generation, distribution and supply in an unserved or underserved territory. The consumer tariff is determined by the Authority after a public hearing, and you must connect anyone within the territory.
Form A-5 · indicative term up to 20 years
Special purpose licence
For a specified electric power service business: a transmission facility within the Province which does not form part of the national grid, storage operated as a business of supplying others, an electric vehicle charging network, a facility on a site vested in Government under section 44, or a pilot project. Conditions as to access, charges and safety are imposed.
