Everything above except the Act is in draft and coming soon. Each will be published for comment before it is made. If you are planning a project and want to know where matters stand, the facilitation desk will tell you, free of charge.

The boundary of the Authority’s competence

The Authority regulates electric power services within the Province for which a licence or registration is required under the Act.

Every application is screened before it is registered. Where any part of the proposed activity falls, or may fall, within the regulatory competence of the Federation or of an authority established under Federal law, the Authority does not proceed upon it.

The application is returned with written reasons and the fee is refunded. It is not severed, and no part of it is processed.

One test to apply first

Is any part of the plant connected, directly or indirectly, to the national grid, including a standby connection? If it is, the project falls outside the provincial framework and the federal framework governs. Declare it early and nobody wastes time.
